General terms and conditions of sale
1. By placing an order on the online store, the Customer declares that he/she has read all the information provided to him/her during the purchase procedure, and fully accepts the general and payment conditions transcribed below. Business to Business On-Line Sales Site.
2. In case of unexpected unavailability of goods and non-acceptance of the order, no charge will be made to the Customer.

Method of Purchase
3. The correct receipt of the order is confirmed by the site www.tntgiusky.com by an automatic response by e-mail, sent to the e-mail address provided by the Customer. This confirmation message will contain Date and Time of the order, an "Order Number", to be used in any further communication with the site www.tntgiusky.com . The Customer will be promptly updated of the status of the order: goods dispatched with Courier Shipping, en route equals status Shipped. Payment will be invoiced within a few days of Shipment whether or not the goods have reached their destination. The invoice is sent via e-mail. If you do not receive it within a few days of delivery, check your Spam email or notify [email protected]
4. It is the Customer's responsibility to register with the correct tax and shipping information and to keep this information up-to-date using login credentials. Invoicing will be by automatic system and no corrections can be made after the invoice has been issued. No responsibility will be attributed to the Company TNT GIUSKY S.R.L. for an incorrect compilation by the Customer of its tax data, data of which the Company TNT GIUSKY S.R.L. cannot be aware.

Methods of payment
5. Credit Card The purchase of goods is expected to be paid by Credit Card (via the secure PayPal system, see payment methods for the specification of accepted cards) or Bank Transfer. For Bank Transfer the currency must correspond to the date of the bank payment. Please note that the customer's submission to TNT GIUSKY S.R.L. of non-existent/fraudulent CRO transaction numbers will be prosecuted in accordance with the law Code of Criminal Procedure. The Card transaction takes place through the electronic system of the site www.tntgiusky.com which uses the secure server of Paypal, through the OpenCart platform; at no time during the purchase process is the electronic system of the site www.tntgiusky.com and no staff member able to know the Customer's credit card number, which is provided by the Customer to the Secure Server of the Credit Institution on a secure internet connection and encrypted according to the current standards of the online payment market. No refund is due to the customer who executes the order, paying with Paypal and DOES NOT COLLECT the goods that are already shipped, due to unreasonable reconsideration. The goods will remain in storage at our warehouses for any reconsideration by the customer (for 15 days) who wanted to pick them up. The return to our premises in Conversano of any rejected goods and the resending to the customer who decides to withdraw them are at the expense of the customer.
6. Currency All amounts displayed on www.tntgiusky.com are expressed in Euro, which is the reference currency.

Mode and cost of delivery
7. Tntgiusky can accept orders with delivery anywhere .
8. For each order placed on www.tntgiusky.com , tntgiusky shall issue an invoice for the material shipped, sending it by e-mail to the order holder with an attachment, in accordance with art 14 D.P.R. 445/2000 and DL 52/2004. For the issuance of the invoice, the information provided by the Customer at the time of the order. No change in the invoice will be possible, after the automatic issuance of the same.
9. Delivery charges are explicitly highlighted when the order is placed. Some promotions may propose discounts equal to the shipping costs for orders above a certain value determined by the offer itself. The payment of the goods by the Customer will take place using the mode Credit Card or Bank Transfer, the charge on the credit card will result applied by TNT GIUSKY S.R.L.  , manager of the integrated e-commerce platform. Nothing is due in addition by the Customer with respect to the total amount of the order.

10. Order fulfillment times are normally 24-72 hours in the Italian peninsula. No responsibility can be attributed to TNT GIUSKY S.R.L. in case of delay in the delivery of what was ordered, by the couriers. The Customer will receive an e-mail for the SHIPMENT STATUS of the goods, in real time, the moment the goods are entrusted to the Courier.

11. At the time of delivery of the goods by the courier, the Customer is required to check: that the number of packages delivered corresponds to what is indicated in the Waybill that the packaging is intact, not damaged, or wet or otherwise altered, even in the sealing materials (adhesive tape or metal or plastic strapping). Any damage to the packaging and / or the product or the mismatch in the number of packages or indications, must be immediately contested, putting WRITTEN RESERVE OF CONTROL on the courier's proof of delivery. Once the goods have been picked up by the courier, the Customer will not be able to make any objection regarding the external characteristics of what has been delivered. Any problems concerning the physical integrity or completeness of the order must be reported within 3 days after delivery, in the manner provided herein.
12. In the event of failure by the customer to collect within 5 working days of the material in storage at the warehouses of the Courier due to repeated inability to deliver to the address specified by the Customer when placing the order, the goods will return to the headquarters of TNT GIUSKY S.R.L. . The costs of any redelivery will be charged to the customer in this case. In case of failure to collect by the customer for reasons attributable to him, the Company TNT GIUSKY S.R.L. is not obliged to make any refund to the customer for the goods purchased and not withdrawn.

Right of withdrawal
13. The customer, consumer with VAT number DOES NOT HAVE ANY RIGHT TO WITHDRAW from the purchase contract, except for the only valid reason of damage or defect of the goods received reason for which our Company is liable in any case, or item other than what was ordered and checked in the order confirmation, to be contested at the time of withdrawal from the Courier itself ( for apparent defect outside of the packaging ) or within 24 hours ( for defect print or cut inside the packaging ), with e-mail to [email protected] In this case any expense of replacement defective goods is borne by the Company TNT GIUSKY S. R.L. No disputes are contemplated AND will NOT be granted withdrawals and / or replacement goods, for incorrect choice by the customer of color gradations of the goods received or incorrect orders always by the customer of format, material or size. THE CUSTOMER BY PLACING THE ORDER FULLY ACCEPTS ALL CONDITIONS OF SALE INCLUDING THOSE OF WITHDRAWAL CLEARLY EXPRESSED IN THIS CONTRACTUAL INFORMATION.
14. Only in case of damage or defective goods, the customer must send TNT GIUSKY S.R.L. a notice to that effect, within 3 working days from the date of receipt of the goods. Such notice must be sent by registered letter with acknowledgment of receipt, addressed to Ditta TNT GIUSKY S.R.L. - Via San Lorenzo 9,- 70014 - Conversano (Ba) or by telegram or fax always sent within the aforementioned period of 10 days and followed by a confirmation by registered letter with acknowledgment of receipt, sent STRICTLY within the next 48 hours. Once we have received the above notice of withdrawal, TNTGiusky will quickly communicate to the customer instructions on how to return the goods, which must be received by TNTGiusky within 7 days of authorization.

15. Right of withdrawal of damaged or defective goods is still subject to the following conditions: the right applies to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the purchased product; the purchased goods must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment); to limit damage to the original packaging, we recommend, when possible, to put it in a second box; it should be avoided in all cases the attachment of labels or adhesive tapes directly on the original packaging of the product; by law, the shipping costs related to the return of the goods are the responsibility of the customer; the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer; in case of damage to the goods during transport, the Customer shall notify TNTGiusky of the incident (within 3 working days of receipt of the goods in their warehouses), to enable us to file a timely complaint against the carrier of his choice and obtain reimbursement of the value of the asset (if insured); in this case, the product will be made available to the customer for its return, at the same time canceling the request for withdrawal; TNTGiusky is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments.
16. Without prejudice to any repair costs for damages ascertained to the original packaging, TNTGiusky will refund the customer the full amount already paid, net of shipping costs incurred, within 14 days from the return of the goods, by transferring the amount charged to the Credit Card or by Bank Transfer. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (IBAN Code of the invoice holder).
17. The right of withdrawal damaged or defective goods is totally forfeited, for lack of the essential condition of integrity of the property (packaging and / or its contents), in cases where TNTGiusky ascertains: the lack of the outer packaging and / or the original inner packaging; the absence of integral elements of the product; the damage of the product for reasons other than its transport. In the case of forfeiture of the right of withdrawal, TNTGiusky will return to sender the purchased goods, charging the same shipping costs.

Privacy
18. The personal data requested when placing the order are collected and processed in order to satisfy the express requests of the Customer and will not under any circumstances and for any reason be transferred to third parties. TNTGiusky guarantees its customers compliance with the regulations on the processing of personal data, governed by the privacy code set out in DL 196 of 30.06.03. Complaints

20. The sales contract between the Customer and tntgiusky is concluded in Italy and governed by Italian Law. For the solution of civil and criminal disputes arising from the conclusion of this contract of sale at a distance, if the Customer is a consumer, the territorial jurisdiction is that of the court of reference of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Bari
